No heir with a claim subordinate to that of Viscount Mountgarret (no.158) is included, nor are any female or illegitimate children, as they would not be in the line of succession. Unless otherwise stated in these notes, the surname should be taken throughout to be "BUTLER", although it was more often rendered at first in post-classical Latin as "PINCERNA", or in Norman French as "BOTILER".

  17. HENRY,14..-14.. There is no reason to suppose he survived infancy, if indeed he existed. He is here included on the authority of Cal. Carew MSS., vol 630, p. 20 in Lambeth Palace Library which was followed by William Ratcliffe, Rouge Croix, 1812, in his MS Pedigree of the Earls of Ormond, in Coll. Of Arms, London.

Earl of Ormond; the 1461 English attainder (see No. 7, supra) was reversed by the first Parliament of Henry VII; created 1489, Lord Ormond, by writ (in the Peerage of England, in tail general); m. 1st., c. 1445, Anne, da. of Sir Richard Hankeford, and by her who d. 1485 had Anne (wife of James St. Leger) and Mary (wife of Sir William Boleyn) both of whom survived him as his co-heiresses and had issue; Thomas m. 2nd., 1..., Lora, da. of Sir Edward Berkeley, and by her who d. 1501 had Elizabeth who d.v.p. unmarried 1510.

Sabina's husband, O'Nolan, seems not to have died until shortly before her marriage to James (No. 12) in 1465 (Butler Jo., I, 38); her illegitimate sons, Edmond and Theobald Butler "lay under a cloak" at their parents' marriage in 1465 (Ormond Deeds, iii, 296-300).

Blake Butler, c. 1960, and now in possession of Lord Dunboyne, add two other sons, John (without any source-reference) and Walter (on the basis of Chancery Bill No. 1851); but Carte, supra, (I), p. lii, stated positively in 1736 that Walter (No. 19) had one son, Pierce.

Earl of Clanrickarde and by her had only No. 33; m. 2nd., 15.., Eleanor, da. of James FitzGerald and by her who d. 1589 had no issue.

  25. PIERCE, c. 1547- c. 1604; attainted, 1570 (see Butler Jo. supra); m. 15.., Catherine, da. of John (Power), Lord Power and by her who d. 1597 had "a great number of sons" (H.M.C. Salisbury, vii, 106-107). So far as is known, the male line from Pierce (No. 22) expired on the death in 1746 of Thomas (No. 92). Mr. Swan's 1968 Pedigree is particularly erroneous with regard to the all-important last generations known to be descended from Pierce (No.22.). Lord Dunboyne is satisfied that Mr. Swan has simply miscopied the 16th. Viscount Mountgarret's additions to an 1849 MS. Pedigree by Betham. [The Chevalier O'Gorman's contention of 1788 (B. 71, O'Gorman MSS, Nat. Lib., Dublin), that the French family of de Butler descends from Pierce (No. 22), is manifestly wrong (see their 1720 pedigree by W. Hinde in the Archives de Charente Maritime, La Rochelle, their 1750 pedigree by J. Hawkins in MS. 162, G.O., Dublin Castle and their 1760 pedigree by P. d'Hozier in Dossier de Butler, No. 1439, Cabinet des Titres, Bibliotheque Nationale, Paris; see also Butler Jo., (I), 67 &108-112)].

Viscount Mountgarret; before joining the Tyrone Rebellion, he was claiming the Ormond earldom in 1596, apparently on the thin ice that he was entitled to the earldom through his mother; m. 15.. Grany, da. of Barnaby (Fitzpatrick), 1st. Lord of Upper Ossory and by her who d. 1... had No. 40.

  29. JAMES, 1583- c. 1590 s.p. He had no legit., but more than 6 illegit., bros. (Carew MSS, 626 & 635, pp. 38-40). The inclusion, in Betham's 1849 MS. Pedigree (supra), of Theobald as a brother, is an obvious mistake and is repeated in Swan's 1968 MS pedigree (supra).

(Piers, a waterman of Galway, claimed to be their son but she denied maternity and he, being s. of Donogh Lenan, was found to be an impostor - Cal. S.P. (1), Jas. I, V, 463 & 523).

  43. PIERCE, c. 1558-1627; the evidence of his three marriages and heirs-male descendants is highly material, but has not been treated methodically by Carte, (supra in 1736, or even by T. Blake Butler, supra, in 1960. The loss of the family's estates at Nodstown, Co. Tipperary, in the time of Cromwell, makes the tracing of any subsequent male line extremely difficult, if not impossible. Pierce (No. 31) m. 1st., 15.., ....., da. of Conor O'Mulryan (Carew MSS., 626 p. 127); m. 2nd., before 7 Aug. 1586, Ellen da. of Thomas Purcell and by her who d. 15.. had Nos. 44 to 49 (No. 45 is named as 2nd. son in Funeral Entries, G.O. Dublin (hereinafter "F.E.") No. 65, Chas. I, and vii, 316, but is omitted from F.E. v, 119 which names the sons as James, Thomas, Edmond, John and Pierce); after Ellen, née Purcell had died ( S.P. (I), Jan. 1600, Eliz. I, x, 171), Pierce (No.31) m. 3rd., 1..., Giles, da. of Sir John Power (Carew MSS., 635, p.40). She was then the widow of Donough Mc Carthy and there is no suggestion that she bore No. 31 any issue.

  45. JAMES, 15..- c. 1579; s.p. (Carte, supra, I, lii). In 1567 when he must have still been a minor, he was granted the annual rent of Duiske Abbey, Co. Kilkenny (Fiant, Eliz. I, No. 1175). His death s.p.m. is indicated by the lease of Duiske Abbey on 2 Nov. 1580 from the 10th. Earl of Ormond (No. 16) to that earl's illegit. Son, Peter (N.E. White, Irish Monastic Deeds, 271 & 274). James (No. 32) may have been slain at the Battle of Gortnabrid,Co. Limerick, on 22 Oct. 1579, when he would have been in his teens.

And 3rd. sons in Ormond Deed No. 3204, supra, of 28 Dec. 1595, but neither is mentioned by Carte, supra, or in either of the Carew pedigrees, supra; their father, Pierce (No. 22) had several illegit. sons, one of whom was called Thomas.

  69. JAMES, 1...-1633; m. 1612, Eleanor da. of Sir John Fitzgerald and by her who d. 1... had Nos. 59 to 68 (F.E., vi, 19). But in view of 17th. Century infant-mortality, James (No. 44) is not likely to have had as many as ten legitimate sons all of whom survived to be named in his Funeral Entry and the fact that four (Nos. 60 to 63) of them have exactly the same names in the same sequence as Nos. 46 to 49 suggests the possibility that Nos. 61 to 63 were included, through a copyist's error, in F.E., vi, 19. If so, they were sons of No. 31 as shown in F.E., v., 119), and not of James (No. 44), apart from Thomas (No.60) of whose existence there seems to be separate evidence. According to Carte, supra, (I), p. lii, the descendants of No. 44 were extinct temp. Chas. II when the family estate (of Nodstown) should have reverted to the Duke of Ormonde (No. 56) if he had not barred himself by the Act of Explanation.
